wants to ad the body shop name also My husband hit a deer in a car we have no loan on. We want to fix it ourselves but we had an appraisal done for the insurance company. They are telling us the check will be written in both our names and the body shop's name. Do they have a legal right to force us to go to the body shop for the repairs when there is no lein holder on the vehicle? We can do it ourselves for alot less and keep the difference. Or can we just ask them fot the check to be written to just us, and do they have to comply?

Legally, you have a right to the check. The Insurance company will fight you tooth and nails and insist it has to be issued in both your name and the body shop. It doesn't ! If you are successful, the insurance will not pay again for the same damage and will probably just cancel you

If there is no lien holder, they should be able to issue the check in your name only. But, to be sure, read your policy.

Let your carrier know there is no lien holder. They may require you to send in a copy of your title to confirm.

you should be able to request a new check be issued in your name only. you have the right to take the car anywhere you want to be fixed. call the adjuster and let him know there is no lein on the car and ask for a new check to be issued
